1.1 Nioel Pty Ltd (ABN 48 698 708 093) ("Nioel," "we," "us") operates the Nioel platform at nioel.com. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
1.2 This Privacy Policy explains what personal information we collect, how we use and disclose it, how we keep it secure, and how you can access, correct, or complain about how we handle it.
1.3 This policy forms part of, and should be read together with, our Terms of Service.
1.4 In this policy, "personal information" means information or an opinion about an identified individual, or an individual who is reasonably identifiable — for example, a name, email address, phone number, or in some cases an IP address or device identifier.
2.1 Information we collect about you. When you deal with Nioel directly — for example, you sign up for or administer a Nioel account, contact us, or visit nioel.com — we collect and handle personal information about you for our own business purposes. This policy governs that information.
2.2 Customer Data we process for our customers. Our customers (typically businesses) load data into their workspace on the platform, which may include personal information about their own employees, customers, and suppliers. For that data, our customer decides what is collected and why, and our customer is the organisation you should contact about it. We only process it to provide the platform to that customer, under our Terms of Service, and we don't use it for our own purposes. If you are an individual whose information was put into the platform by one of our customers, please contact that customer in the first instance; if you contact us, we will refer your request to them or assist them in responding.
3.1 Account and contact information — such as your name, business email address, phone number, job role, and the login details of authorised users.
3.2 Billing and payment information — such as billing contact details and payment information. Card payments are processed by our payment provider, Stripe; we do not store full card numbers ourselves.
3.3 Communications — the content of emails, support requests, and other messages you send us.
3.4 Website and technical information — such as your IP address, browser and device information, pages viewed, and interactions with nioel.com, collected through cookies and analytics tools (see section 8).
3.5 We do not seek to collect sensitive information (such as health, biometric, or similar information) through our own dealings with you. Please do not send us sensitive information unless we specifically ask for it.
4.1 We collect most personal information directly from you — when you create or administer an account, communicate with us, or use nioel.com.
4.2 We may also collect information automatically through cookies and analytics tools when you use our website (see section 8), and from third parties such as our payment provider in connection with billing.
5.1 We use personal information to: provide, operate, and support the platform; set up and manage accounts and authorised users; process payments and issue invoices; respond to enquiries and provide customer support; maintain the security and integrity of the platform; comply with our legal obligations; and improve our products and services.
5.2 We will only use personal information for the purpose for which it was collected, for a related purpose you would reasonably expect, or where you have consented or the law permits or requires it.
6.1 We do not sell personal information.
6.2 We disclose personal information to a limited number of service providers ("sub-processors") who help us operate the platform and run our business, including: hosting and cloud infrastructure providers; our payment provider (Stripe); and website analytics providers (such as Microsoft Clarity). These providers are only permitted to use the information to provide their services to us.
6.3 We may also disclose personal information where required or authorised by law, to establish or defend our legal rights, or with your consent.
7.1 We use service providers located both in Australia and overseas. As a result, personal information may be stored and processed outside Australia — including in the United States (where providers such as Stripe and Microsoft operate) and other countries where our hosting and service providers are located.
7.2 Where we disclose personal information to an overseas recipient, we take reasonable steps to ensure it is handled in a manner consistent with the APPs, including through our contracts with those providers. By using the platform, you acknowledge that your personal information may be stored and processed overseas as described.
8.1 nioel.com uses cookies and similar technologies, and analytics tools such as Microsoft Clarity, to understand how the website and platform are used, to remember your preferences, and to improve performance and usability.
8.2 These tools may collect information such as your IP address, device and browser type, pages visited, and on-page interactions (which may include session recordings or heatmaps). You can control or disable cookies through your browser settings, although some features may not work properly if you do.
9.1 We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification, or disclosure — including access controls, logical separation of customer workspaces, encryption of data in transit, and use of reputable infrastructure providers.
9.2 No system is completely secure. If we become aware of a data breach likely to result in serious harm, we will respond in accordance with the Notifiable Data Breaches scheme and notify affected individuals and the Office of the Australian Information Commissioner (OAIC) where required.
10.1 We keep personal information only for as long as we need it for the purposes described in this policy, or as required by law.
10.2 For Customer Data, our retention and deletion practices are set out in our Terms of Service — including providing an export on request and deleting Customer Data from production systems within a defined period after termination, subject to retention required by law and reasonable backup cycles.
11.1 You can ask us to access the personal information we hold about you, or to correct it if it is inaccurate, out of date, or incomplete. Contact us using the details in section 14.
11.2 We will respond within a reasonable period. There is normally no charge, though we may recover reasonable costs for some access requests. If we decline a request, we will explain why and how you can complain.
11.3 If your request concerns data that one of our customers loaded into the platform (see clause 2.2), we will refer you to, or work with, that customer.
12.1 We do not currently send marketing emails. If we introduce them in future, we will only send them where permitted, and every message will include an easy way to opt out. You can also ask us at any time to stop sending you marketing communications.
13.1 If you have a concern or complaint about how we have handled your personal information, please contact us using the details in section 14. We will acknowledge your complaint and aim to resolve it within a reasonable period.
13.2 If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
